Texas Insurance Law Timelines
The Texas Insurance Code has specific timelines for insurance companies to acknowledge and accept or reject first-party claims. For example, the insurer must acknowledge a first-party claim within 15 days of receipt and make payment within five days of acceptance. As a policyholder, you may be entitled to a substantial penalty payment from your insurer and attorney’s fees if your insurance company misses the deadlines.
After acknowledging your claim, the insurance company will likely send out a claims adjuster to inspect and evaluate the damage. Insurance companies that fail to attempt to reach a fair and reasonable settlement of a first-party claim when the insurer’s liability is reasonably clear may be held liable for acting in bad faith. As a policyholder, you may have a right to bring a claim under the unfair practices section of the Texas Insurance Code and be entitled to collect damages beyond the amount of the insurance claim.
