Texas Motorcycle Accidents Often Have Significant Consequences
According to the Texas Department of Transportation, 529 motorcyclists were killed and 6,986 motorcyclists were seriously injured in Texas motorcycle accidents during 2008.
The laws surrounding motorcycle wrecks are similar to those for automobile accidents. Where these types of accidents differ is in the increased severity of injuries that often result from motorcycle accidents. Individuals involved in a motorcycle accident are at a high risk for broken bones and fractures, head trauma, skin injury (commonly referred to as road rash), spinal cord injury and death. A 2008 federal study found that motorcyclists with a single leg or foot injury -- common injuries in motorcycle crashes -- had a median hospital charge of $20,745. Motorcyclists with a lower-extremity injury, combined with other injuries, had median hospital charges of $56,288.
Establishing Liability for Texas Motorcycle Accidents
Motorcyclists may cause an accident by driving
too fast, weaving in and out of traffic, failing to
drive in appropriate lanes, or
driving under the influence of drugs or alcohol
(DUI / DWI). Often, however, motorcycle accidents
are caused by other drivers on the road who neglect
to check their mirrors and blind spots before
changing lanes or who do not allow sufficient
braking distance when following a motorcycle. Many
accidents involving motorcyclists occur at
intersections, where other drivers carelessly pull
out in front of or turn into motorcyclists.
These drivers may be found liable for injuries
sustained in an accident if the motorcycle accident
victim, or the victim’s survivors, prove that the
driver drove negligently. A driver is negligent if
the driver failed to drive with the caution that a
reasonably prudent person would use while driving
and if the driver’s actions caused the victim’s
injuries.
Recovering Damages for Texas Motorcycle Accidents
In order to recover damages for injuries sustained in a motorcycle accident, you must be the victim, or the surviving relative of the victim, and prove that the defendant’s negligence caused the injuries. You need the assistance of a dedicated motorcycle accident lawyer to prove your case. Then, you may be awarded some or all of the following damages, including compensation for:
- Past and future medical bills;
- Past and future loss of income;
- Out-of-pocket expenses including property damage, nursing care costs, and household help necessitated by your injuries;
- Disabilities; and
- Pain and suffering.
Motorcycle accident attorney Brad Wyly will work hard to help you receive fair and just damages for your injuries. He will negotiate with insurance companies, and if an equitable settlement cannot be reached, he will proceed to trial.
